Ohio football players' rape trial will not be moved

A judge ruled Wednesday to keep the upcoming trial of two high school football players charged with raping a 16-year-old girl in the eastern Ohio county where the attack allegedly happened, rejecting requests by the defendants' attorneys who wanted the trial moved.

Prosecutors had opposed the request by the defendants' lawyers, who said some potential witnesses had been threatened and could face intimidation or harassment outside the local courthouse.

Judge Thomas Lipps also said the nonjury trial should be open to the public and media. He set the trial date for March 13.

Adam Nemann, an attorney for defendant Trent Mays, argued Friday the case should be moved to a county with a bigger courthouse where crowds of protesters potentially trying to intimidate witnesses favorable to the accused could be better controlled.

"My big concern is that witnesses aren't going to come in walking past hundreds of people wearing masks," Nemann said.

Brian Deckert, a special prosecutor from the Ohio attorney general's office, responded that witnesses could be compelled to testify by subpoena and would have to testify truthfully because of perjury laws.

Lipps also said the trial would be open to the public, overruling objections by the girl and her family, who wanted to protect her identity and keep evidence that might be ruled inadmissible from becoming public.

A lawyer for defendant Ma'Lik Richmond initially wanted the trial closed, then changed his mind. Closing the trial would have hinged largely on Richmond's concerns - related to possible witness intimidation - since his right to a fair trial was the main issue before Lipps.

The Associated Press generally does not identify juvenile suspects, but Mays' and Richmond's names have been widely reported by local and national media outlets.

Three other students who witnessed the attack but weren't charged are expected to testify at next month's trial. The girl attends a different high school across the river in West Virginia.

Prosecutors say the girl was attacked twice after an alcohol-fueled party last August, once in a car and once in the basement of a house. The AP generally doesn't identity people who say they are the victims of sexual assault.

RNA Fragments May Yield Rapid, Accurate Cancer Diagnosis

Fragments of RNA that cells eject in fatty droplets may point the way to a new era of cancer diagnosis, potentially eliminating the need for invasive tests in certain cases. Cancer tumor cells shed microvesicles containing proteins and RNA fragments, called exosomes, into cerebral spinal fluid, blood, and urine. Within these exosomes is genetic information that can be analyzed to determine the cancer?s molecular composition and state of progression. Researchers at Massachusetts General Hospital discovered that exosomes preserve the genetic information of their parent cells in 2008, however exosomes have not seen widespread clinical testing as a means of cancer diagnosis until now. ?We have never really been able to detect the genetic components of a tumor by blood or spinal fluid,? says Harvard University neurologist Fred Hochberg. ?This is really a new strategy.? He says exosome diagnostic tests could potentially detect and monitor the progression of a wide variety of cancers. He is one of the lead researchers in a multicenter clinical study using new exosomal diagnostic tests developed by New York City-based Exosome Diagnostics to identify a genetic mutation found exclusively in glioma, the most common form of brain cancer. When treating other forms of cancer, surgeons are able to biopsy tumors to diagnose and monitor the state of the disease. For brain cancers like glioma, however, multiple biopsies can be life threatening. Bob Carter, head of neurosurgery at the University of California, San Diego, says well-preserved RNA in blood and spinal fluid enables researchers to test and monitor for these genetic changes noninvasively. He says study researchers separate exosomes from bio-fluids with a diagnostic kit and then extract the relevant genomic information. Once the specific cancer mutation is identified, clinicians will periodically draw additional bio-fluids to monitor the mutation levels to determine whether a patient is responding to therapy.?? Whereas Magnetic Resonance Imaging (MRI) is a useful tool, tumors only show up on imaging scans once they are at least one millimeter in diameter and comprise about 100,000 tumor cells. By that time, it may be too late for an early intervention. On the flip side, MRIs can also yield false positives. Hochberg says individuals who have been treated with conventional radiation therapy often have benign residual tissue from dying tumor cells that have been killed by the treatment but which the body has not yet eliminated. This tissue is often mistaken for tumor growth on a MRI scan. ?You would identify to the patient that the drug is not working when in reality it is doing well,? Hochberg says. ?On the other hand, having an easily accessible biomarker for glioma would give you a clear response.? There are 18 U.S. hospitals participating in the clinical trial, sponsored by the Accelerated Brain Cancer Cure Foundation. Hochberg says study researchers have recruited 41 of 120 patients so far. Preliminary results will be presented in April at the International Society for Extracellular Vesicles Symposium in Boston. From a technical standpoint I don?t believe there is a barrier,? Carter says. ?This test can certainly be used now, what we are trying to finalize is the sensitivity and specificity of the test.? Exosomes may be a reliable method of screening for prostate cancer as well. A PSA test is currently the most common, noninvasive means to screen for prostate cancer in the U.S. PSA testing measures for elevated levels of prostate-specific antigen, a protein produced by the prostate gland that is used to liquefy semen in men. The higher a man?s PSA level, the more likely it is that he has prostate cancer, says James McKiernan, director of urologic oncology at Columbia University Medical Center. There are additional reasons, however, for high PSA levels-and some men with prostate cancer do not always have elevated PSA, he added. In addition, for many cases of prostate cancer, new research published in May 2012 in The New England Journal of Medicine shows that treatment does not actually extend the life of the patient. ?Honestly PSA is not cancer-specific,? says Sudhir Srivastava, head of the National Cancer Institute?s Cancer Biomarkers Research Group. ?Exosomes could be very much [more] cancer specific. PSA might give you one specific biomarker for cancer identification, but exosomes can give you an entire disease specific profile so you would know whether or not it is a form of prostate cancer that necessitates treatment.? Researchers at Exosome have developed a diagnostic kit for prostate cancer with a diagnostic accuracy of around 75 percent-a rate comparable with that of actually taking a tissue biopsy, says Wayne Comper, a renal physiologist and chief science officer at Exosome. He says the first diagnostic kit could be available commercially by the end of 2013. Researchers use the kit to look for the genetic biomarker TMPRSS2:ERG or T:E in exosomes taken from a urine sample. Comper says levels of T:E are nine times higher in a cancerous prostate versus a healthy one. McKiernan says researchers found these exosomal diagnostic tests gave better predictive results for cancer than current prescreening methods, such as PSA. PSA levels are measured via a blood draw but also require a visit to a doctor?s office for a digital rectal exam, something that isn?t necessary with an exosomal diagnostic test. ?Our study got enough interest to put together a series of sites for investigation to lead to potential FDA approval of this particular kit,? he says. ?That is ongoing right now and the last time I checked there were about 1,000 patients who have been enrolled in the study.? Srivastava says Exosome's prostate kit could prove to be extremely relevant in cancer treatment if it survives the U.S. Food and Drug Administration?s grueling approval process. He says it is a precursor to what he hopes will be a series of multiple-gene-signature cancer tests. ?We are looking for something with about 90 percent accuracy before it can be used by itself for clinical diagnosis,? he says. ?NCI has done two prostate trials with exosomes to date and is looking into creating standard isolation procedures to make the tests more specific.? In the meantime Srivastava says exosomal tests could be used in conjunction with current methods of diagnosis like PSA to help physicians better determine if the nature of a prostate tumor is severe enough to warrant radical treatment or removal without ever performing a biopsy. ?If someone has high PSA and also has biomarkers which are positive in exosomes that would be a great test,? he says. ?Exosomes have the potential to really further the detection of cancer and help analyze things that would have otherwise not been detected noninvasively.? ? McCain warns GOP on immigration

Failure to pass comprehensive immigration reform could have disastrous political consequences for Republicans in red states with growing Hispanic populations, Republican Arizona Sen. John McCain, a key player in drafting the blueprint for an immigration overhaul, said Wednesday.

"The Republican party has failed to understand to a significant degree the importance of this issue to our Hispanic voters," McCain said during a breakfast sponsored by Politico. "I think the trend will continue of lack of support from Hispanic voters and also as you look at the demographics of states like mine, that means we will go from Republican to Democrat over time."

A bipartisan working group of eight senators on Monday unveiled principles they hope will guide congressional efforts to write a law that offers a path to legality for illegal immigrants in exchange for enhanced border security.?The push comes after a national election in which more than 70 percent of Hispanic voters overwhelmingly supported Democratic President Barack Obama's re-election over Republican challenger Mitt Romney.

The election served as a wake-up call for Republicans who feel the constituency of one of the fastest-growing groups is slipping away and emboldened Democrats who see it as an opportunity to bring states like Texas and Arizona, which traditionally support Republicans, into their fold.

McCain said Republicans currently have a perception problem with Hispanic voters, and suggested that working to pass a comprehensive bill could be a major opportunity to reengage them.

"We are elected to office because voters think we will help them achieve their hopes and dreams and aspirations for the future," McCain said. "If you have a large bloc of Americans who believe that you are trying to keep their...fellow Hispanics down, and deprive them of an opportunity, obviously that's going to have an effect on their voters."

To open the Senate Judiciary Committee hearing on gun legislation, former Rep. Gabrielle Giffords gave a short, impassioned speech imploring Americans and Congress to act on gun violence. She read carefully from a script, a task she undertook very carefully and at times with difficulty.

Below is what Giffords said. She left the room shortly thereafter.

"Thank you for inviting me here today. This is an important conversation for our children , for our communities, for Democrats, and Republicans. Speaking is difficult but I need to say something important: Violence is a big problem too many children are dying. Too many children. We must do something. It will be hard, but the time is now! You must act! Be bold, be courageous, Americans are counting on you. Thank you!" Giffords said.

Mark Kelly's Opening Statement : "We are Simply Two Reasonalbe Americans Who Have Said: Enough

We aren't here as victims. We're speaking to you today as Americans. We're a lot like many of our fellow citizens following this debate about gun violence:

We're moderates. Gabby was a Republican long before she was a Democrat.

We're both gun owners, and we take that right and the responsibilities that come with it very seriously.

And we watch with horror when the news breaks to yet another tragic shooting. After 20 kids and six of their teachers were gunned down in their classrooms at Sandy Hook Elementary, we said, this time must be different. Something needs to be done.

We are simply two reasonable Americans who have said: Enough.

Kelly's Solution:

First, fix gun background checks. The holes in our laws make a mockery of the background check system. Congress should close the private sales loophole and get dangerous people entered into that system.

Second, remove the limitations on collecting data and conducting scientific research on gun violence.

Enact a tough federal gun trafficking statute. This is really important.

And finally, let's have a careful and civil conversation about the lethality of firearms we permit to be legally bought and sold in this country.

Leahy: 2nd Amendment Isn't At Risk, 'What is at Risk are Lives.'

The longtime Vermont Democrat and Judiciary Committee chairman is reliably liberal on most matters, but he has a more moderate view of gun control. He has spoken of the rifle range on his own Vermont property. In his opening statement, the Democrat was careful to point out Supreme Court cases that enshrine the 2nd amendment.

Now, at the outset of this hearing, I note that the Second Amendment is secure and will remain secure and protected. In two recent cases, the Supreme Court has confirmed that the Second Amendment, like the other aspects of our Bill of Rights, secures a fundamental individual right. Americans have the right to self- defense and, as the court has said, to have guns in their homes to protect their families. No one can take away those rights or their guns. Second Amendment rights are the foundation on which our discussion rests. They're not at risk.

But what is at risk are lives. Lives are at risk when responsible people fail to stand up for laws that will keep guns out of the hands of those who use them to commit murder, especially mass murders. I ask we focus our discussion on additional statutory measures to better protect our children and all Americans. I say this as a parent and as a grandparent.

Ours is a free society, an open society. We come together today to consider how to become a safer and more secure society.

Grassley: Obama Gun Argument Turns Constitution 'On Its Head'

Sen. Chuck Grassley, an Iowa Republican, offered his party's opening statement at the hearing. He noted the tragedies of Newtown and Tucson and praised Giffords. But he added: "Although Newtown and Tucson are terrible tragedies, the deaths in Newtown should not be used to put forward every gun control measure that has been floating around for years. The problem is greater than guns alone."

Grassley argued that mental health policy should be included in the discussion and so should an examination of pervasive violence in video games.

He argued that limiting the size of magazines would be inefffective and only hurt people seeking to protect themselves.

"We hear that no one needs to carry larger magazines than those that hunters use to shoot deer," he said. "But an attacking criminal, unlike a deer, shoots back."

But Grassley's most important argument was a refutation of President Obama's recent argument that the 2nd Amendment should not trump the right of Americans to safely assemble and he cited the shootings at churches and schools and shopping malls.Those people, the president said, were deprived of a more basic right to live, liberty and pursuit of happiness. Grassley took extreme issue with that argument, which he suggested perverts the Constitition.

I was taken aback when the President cited the Declaration of Independence and the Constitution as sources of government power to restrict gun ownership rights.

The Constitution creates a limited federal government. It separates powers among the branches of the federal government and it preserves state power against federal power. The Framers believed these structures would adequately control the government so as to protect individual liberty. But the American people disagreed. They feared that the Constitution gave the federal government so much power that it could be tyrannical and violate individual rights. So a Bill of Rights was added to the Constitution. Each of those rights, including the Second Amendment, was adopted to further limit government power and protect individual rights.

President Obama's remarks turned the Constitution on its head. He said, "The right to worship freely and safely, that right was denied to Sikhs in Oak Creek, Wisconsin.

"The right to assemble peacefully, that right was denied shoppers in Clackamas, Oregon, and moviegoers in Aurora, Colorado. That most fundamental set of rights to life and liberty and the pursuit of happiness - fundamental rights that were denied to college students at Virginia Tech, and high school students at Columbine, and elementary school students in Newtown?"

But this is not so. Except for its prohibition on slavery, the Constitution limits only the actions of government, not individuals.

So, for instance, the right to peacefully assemble protects individual rights to organize to protest or seek to change governmental action.

That right is trivialized and mischaracterized as protecting shopping and watching movies.

Leahy and LaPierre Tangle on Background Checks:' "Please I'm Not Trying to Play Games Here."

Sen. Patrick Leahy asked NRA head Wayne LaPierre about the universal background checks. LaPierre would not take the question head-on, arguing instead that circumstances had changed since the 1990s and he ultimately said the organization does not support them.

LaPierre argued that adding more background checks would be ineffective, because those failing the checks are not prosecuted.

"The fact is the law right now is a failure as it is," LaPierre said.

But Leahy was not happy with the answer and accused LaPierre of evading the question. LaPierre responded heatedly and annoyed saying it might not address the question but he "honestly" believes that is the answer.

"Please I'm not trying to play games here," Leahy said.

The Young Women are Safer With Guns Argument

When Gayle Trotter was advocating on behalf of arming women, even saying that young women say an AR-15 is their weapon of choice, she started to say I stand for millions of women across this country. There were audible hisses and moans from the audience and someone said "No you don't!"

Trotter is a Washington lawyer and a fellow at the Independent Women's Forum.

"Guns make women safer," said Trotter. "Over 90 percent of violent crimes occur without a firearm, which makes guns the great equalizer for women. The vast majority of violent criminals use their size and their physical strength to prey on women who are at a severe disadvantage. In a violent confrontation, guns reverse the balance of power. An armed woman does not need superior strength or the proximity of a hand-to-hand struggle. "

She later said the AR-15, an assault rifle, is the type of gun women should get.

Her argument was disputed by Baltimore County Police Chief James Johnson, who said a gun in the house can turn otherwise harmful violence deadly.

The Everyone is Safer With Guns Argument

David Kopel, an analyst at the Cato institute, gave numbers-laced testimony in favor of introducing more guns and against universal background checks.

"Mandating universal checks can only be enforceable if there is universal gun registration, and we know that universal gun registration in every country in the world where it's existed has been a serious peril to gun ownership," he said.

"If we want to save lives right now, not with constructive reforms that might do some good in the future, there is only one thing that will stop the next copycat killer, and that is lawful armed self- defense in the schools, not only by armed guards but also by teachers. Utah provides the successful model," said Kopel. "There, a teacher who has a permit to carry - after a background check and a safety training class - everywhere else in the state is not prohibited from carrying at the schools. "

Feinstein Welcomes Assault Weapons Ban Nemisis -

The top national spokesman for a new Assault Weapons Ban is California Democrat and Sen. Feinstein, who wrote the '94 version. There was a moment of levity when Feinstein welcomed the witnesses to the hearing? "Even Mr. LaPierre, it's good to see you?we tangled maybe 18 years ago?you were pretty good."

He smiled back at her. Leahy gave Feinstein back a few seconds of time to make up for the laughter in the hearing room.

Hearing Leans Against Gun Control -

ABC's Arlette Saenz notes from the hearing room: The makeup of the panel leans in the anti-gun control position. Wayne LaPierre of the NRA, Professor David Kopel of Denver University and Gayle Trotter of the Independent Women's Forum fall into the anti-gun control camp while Mark Kelly and Baltimore Chief of Police James Johnson favor gun control and specifically are advocating on behalf of strengthening background checks.

Durbin: The Problem is Too Many Guns

Illinois Sen. Dick Durbin, an advocate of tougher gun laws, pointed to urban violence in Chicago as a reason for tougher laws. He pointed to the slaying overnight of a 15 year-old Chicago honor student who was killed at a park. He argued the problem is there are too many guns in this country. And he said Chicago has more guns than just about anywhere. But Durbin argued the guns in Chicago are coming from places like Mississippi, where the laws are looser. He also asked Wayne LaPierre about the fear of some gun rights activists that fewer guns would mean they would be unable to rise up against the government. LaPierre said that is an argument with historical basis.

Kelly on High Capacity Magazines -

A heated argument erupted on high capacity magazines. Dick Durbin argued with Kopel about how many bullets should be allowed in a magazine. Kopel said a hundred round magazine would be silly and not function. But he defended 33 round magazines. Kelly interjected that that if Jared Loughner had had a 10 round magazine he probably would not have been able to shoot Christina Taylor Green, the nine year-old girl he killed. She was killed, Kelly said, with the 13th round. And Loughner dropped his second magazine. Kelly has been clinical and direct in discussing the shooting.

Graham Says He's Not Unreasonable -

He wants the wrong people to have fewer bullets. And the right people to have more bullets. Graham pointed to the story of an Atlanta woman who was unable to drop an intruder with six bullets. He said she should have had more. But he said it should be the goal to keep bullets out of the hands of the wrong people. And he should not be disparaged for that opinion.

How Many Rounds are Constitutional? -

David Kopel, the lawyer and CATO analyst, argued that limiting magazines to 10 rounds would clearly be unconstitutional. He didn't seem so sure about a 19 round clip, say. He was referring to the Supreme Court's Heller decision. The Constitution has evolved, clearly, from a time before there were any magazines whatsoever. It was written when armies carried muskets and fired cannons.

Arming Women vs. Women in Combat -

One of the key moments in this hearing came when Gayle Trotter stared down Sen. Sheldon Whitehouse, the Rhode Island Democrat, and told him he couldn't understand what it felt like to be an unarmed new mother. She earlier in the hearing suggested women carry AR-15 rifles. But while Trotter supports arming more women, her group, the Independent Women's forum, does not support women in combat, another subject in the news. Why? In part, Trotter argued "chivalry will be dead."

ABC's Arlette Saenz points this posting from a different IWF staff-member, Charlotte Hays, on their website:

I would also like to add that I think women in combat will be harmful to men. What kind of man doesn't rescue a woman in distress? Our military took risks to rescue Jessica Lynch when she was captured in Iraq in 2003 that it might not take for a man. If we are to put women in the front lines, men will be forced to learn to act more like the men on the Costa Concordia than the Titanic. Chivalry will be dead, and, unfortunately a lot of women will be harmed in a more directly physical manner.

Kelly on Armed School Guards - Mark Kelly draws on his experience as a pilot being shot at and says the chaos of a firefight is an argument armed guards as a panacea.

LaPierre's World View -

NRA CEO Wayne LaPierre several times pointed to the fact that the powerful - members of Congress and titans off industry - have armed guards. They have security, he argued, but the normal American does not and so they need to be able to protect themselves. And that seems to be part of the essence of this argument. There are people who think the government should work to protect its citizens from people with guns. And there are those who think people should be empowered to protect themselves. It is a matter of divided perspective in this country.

Focus turns to Brazil club safety after fire

(AP) ? There was no alarm, no extinguishers, no sprinklers and almost no escape from the nightclub that became a death trap for more than 200 Brazilian college students.

As investigators began poking through the rubble and families mourned their dead, questions abounded as the university city in southern Brazil tried to understand how the Sunday morning blaze that killed 231 people could have been sparked in the first place, then rage rapidly out of control.

Why was there only one door available for exit and entry? What was the flammable material in the ceiling that allowed the conflagration to move so quickly? And, more pointedly, why was a band playing at the club allowed to use pyrotechnics inside the building?

Police were leaning toward the band's pyrotechnics as the cause of the blaze during a party at the Kiss nightclub organized by several academic departments at the Federal University of Santa Maria. Inspector Antonio Firmino, who's part of the team investigating the fire, said it appeared the club's ceiling was covered with an insulating foam made from a combustible material that ignited with the pyrotechnics.

Firmino said the number and state of the exits is under investigation but that it appeared that a second door was "inadequate," as it was small and protected by bars that wouldn't open.

The disaster, the worst fire of its kind in more than a decade, also raises questions of whether Brazilian authorities are up to the task of ensuring safety in such venues ahead of it hosting next year's World Cup and the 2016 Olympics.

Some critics have said conditions in many Brazilian bars and clubs are ripe for another deadly blaze. They say that in addition to modernizing sometimes outdated safety codes and ensuring sufficient inspectors, people must change their way of thinking and respect safety regulations.

Hundreds of people marched peacefully outside the nightclub Monday night to remember the victims, and demand justice. Some carried signs with slogans such as, "May God's justice be carried out."

"We hope that the justice system, through its competent mechanisms, succeeds in clarifying to the public what happened, and gives the people an explanation," said marcher Eglon Do Canto.

Brazilian police said they detained three people Monday in connection with the blaze, while the newspaper O Globo said on its website that a fourth person had surrendered to police. Police Inspector Ranolfo Vieira Junior said the detentions were part of the ongoing police probe and those detained can be held for up to five days.

Vieira declined to identify those detained, but local media has identified them as two co-owners of the club, and two members of the band that was using a spark machine inside the building when the fire erupted.

According to state safety codes here, clubs should have one fire extinguisher every 1,500 square feet as well as multiple emergency exits. Limits on the number of people admitted are to be strictly respected. None of that appears to have happened at the Santa Maria nightclub.

"A problem in Brazil is that there is no control of how many people are admitted in a building," said Joao Daniel Nunes, a civil engineer in nearby Porto Alegre. "They never are clearly stated, and nobody controls how many people enter these night clubs."

Rodrigo Martins, a guitarist for the group Gurizada Fandangueira, told Globo TV network in an interview Monday that the flames broke out minutes after the employment of a pyrotechnic machine that fans out colored sparks, at around 2:30 a.m. local time.

"I felt that something was falling from the roof and I looked up and I saw the fire was spreading, and I shouted 'Look, it's catching on fire, man, it's catching fire,'" Martins said. "Then the drummer tried to throw water on it, and it looked like the fire spread more then. Then the security guards came with an extinguisher, tried to use it, but it didn't work."

He added that the club was packed and estimated the crowd at about 1,200-1,300 people.

"I thought I was going to die there. There was nothing I could do, with the fire spreading and people screaming in front."

Standing next to the stage when the fire broke out, Rodrigo Rizzi, a first-year nursing student, watched the tragedy unfold.

"I was right there, so even though I was far from the door, at least I realized something was wrong," he said. "Others, who couldn't see the stage, never had a chance. They never saw it coming."

As he headed toward the door, the air turned dense and dark with smoke; there was no light, nothing pointing to the single exit. Rizzi found himself clawing through a panicked crowd that surged blindly toward the door.

"I was halfway across the floor, I could see the door, but the air turned black with this thick smoke," he said. "I couldn't breathe. People started to panic and run toward the door. They were falling, screaming, pulling at each other."

Witnesses said security guards who didn't know about the blaze initially blocked people from leaving without paying their bills. Brazilian bars routinely make patrons pay their entire tab at the end of the night before they're allowed to leave.

Inside the club, metal barriers meant to organize the lines of people entering and leaving became traps, corralling desperate patrons within yards of the exit. Bodies piled up against the grates, smothered and broken by the crushing mob.

About 50 of the victims were found in the club's two bathrooms, where the blinding smoke caused them to believe the doors were exits.

Martins confirmed that the group's accordion player Danilo Jacques, 28, died, while the five other band members made it out safely. Martins said he thought Jacques made it out of the building and later returned to save his accordion.

The first funeral services were held Monday for the victims, including brothers Pedro and Mercello Salle. Most of the dead were college students 18 to 21 years old, but they also included some minors. Almost all died from smoke inhalation rather than burns.

National Health Minister Alexandre Padilha cautioned that the death toll could worsen dramatically, telling news media in Santa Maria on Monday that 75 of those injured were in critical condition and could die.

Santa Maria Mayor Cezar Schirmer declared a 30-day mourning period, and Tarso Genro, the governor of the southern state of Rio Grande do Sul, said officials were investigating the cause of the disaster.

The blaze was the deadliest in Brazil since at least 1961, when a fire that swept through a circus killed 503 people in Niteroi, Rio de Janeiro.

Sunday's fire also appeared to be the worst at a nightclub anywhere in the world since December 2000, when a welding accident reportedly set off a fire at a club in Luoyang, China, killing 309 people.

Aries headquarters resided in an imposing building consisting of three floors and incorporating several architectonic styles: it took on a shape reminiscent of a pagoda, high roofs also bore great resemblance to those of real pagoda, consisting of extremely long, arched tiles lined up one after the other and possessing simple curved protrusions jutting upwards on the building's angles. On the highest roof, topping the summit of the building, sat a simple, round and pointed dome, highly reminiscent of those seen on Arabian buildings. The roof below the one with the dome, the middle one, housed a large banner with Aries's symbol on it, held up by a pair of vertical poles. The building's large entrance was again Arabian in design, with its shape being reminiscent of that of the dome on the summit, and above it was the guild's name. The dorms are to the west of the guild building.

Basement

The guild also had a basement, which had a stone floor and housed several round tables complete with chairs, as well as a number of book shelf's lining the walls of the room. The walls seemed to consists of cement reinforced with wood beams, and other, coarse wood beams placed vertically held up the ceiling, with smaller ones branching off from them horizontally and connecting them to the walls and to each other. First Floor

The inside was similar to a large lunch hall, and mainly consisted of wood, possessing a parquet floor and a mezzanine held up by wood beams overlooking it. Several long benches and the tables stretched across its length with a bar at the end.The request board was located beside the bar.

Second Floor

The second floor, which was off limits to everyone under A and B rank, contained another request board which was dedicated strictly to dangerous Jobs, off-limits to everyone except A and B rank Mages. The floor appears to have a few, small round tables and chairs. The A and B rank Request Board is located on this floor. It is a brown, decorative board that is set off into it's own area.

Third Floor

This is the guild masters privet room and is off limits to all

2 rescued after small plane crash on Hudson River

YONKERS, N.Y. (AP) ? Two people were rescued Sunday when their single-engine plane crashed and sank into the icy Hudson River off Yonkers, authorities said.

The small plane was carrying a man and a woman on a sightseeing trip, and crashed about 5:20 p.m., Yonkers Police Lt. Phil Collins said. The two were wearing life vests and were able to get out of the plane before it sank, Collins said.

The cause of the crash was under investigation.

The couple were plucked from the waters within 30 minutes of the crash and taken to Jacobi Medical Center. They were treated for hypothermia and were listed in stable condition at Jacobi, Lt. Toni Scherer of Empress Ambulance Service said. The names of the two were not immediately released.

Federal Aviation Administration spokeswoman Kathleen Bergen described the plane as a Piper PA-32. Bergen said the pilot told local authorities the flight left from the Trenton-Robbinsville Airport in Robbinsville, N.J. It was flying under visual flight rules and not receiving air traffic control services, she said.

The Journal News reported that Yonkers police officers and a retired detective took a boat out to rescue the two.

"Thank God we got there quick enough," said Daniel Higgins Sr., an off-duty police officer who piloted the boat.

In 2009, Capt. Chesley "Sully" Sullenberger safely landed US Airways Flight 1549 on the Hudson River in New York after striking a flock of geese. All 155 people aboard survived.

Guantanamo inmate seeks European court ruling against Poland

WARSAW (Reuters) - Lawyers for a man who says the CIA held him in a secret prison in a Polish forest asked the European Court of Human Rights (ECHR) on Monday to rule on his case because they say a criminal investigation run by Poland is going nowhere.

The decision by lawyers for Saudi-born Abu Zubaydah to go to the court in Strasbourg raises fresh questions about how serious Poland is about investigating allegations that the CIA, as part of a global operation to detain suspected al Qaeda militants a decade ago, used facilities on Polish territory.

Poland is the only country in the world known to have opened a criminal investigation into the alleged CIA jails, but it is now in its fifth year and there is no sign that anyone is close to being put on trial.

"Polish authorities ... have failed to conduct a thorough, effective and timely criminal investigation," said a letter that lawyers for Abu Zubaydah, now held in the U.S. military jail at Guantanamo Bay, said they had faxed to the ECHR on Monday.

"In 2008, a criminal investigation was opened, but it was limited in scope, shrouded in secrecy, and it has made little or no progress in practice," said the letter. "It has become apparent to the applicant that there is no meaningful prospect of a remedy being available to him in Poland."

The letter notified the ECHR that Abu Zubaydah's lawyers would be filing a formal application for a hearing. They want the court to rule on whether Polish officials violated his human rights by helping U.S. intelligence agents to detain him.

The ECHR has already taken up the case of another Saudi man who says he was held in a CIA-run jail in Poland - Abd al-Rahim al-Nashiri.

SLOW INVESTIGATION

If the Polish criminal investigation founders, human rights campaigners say it will greatly reduce the chances that the full picture about the methods used by the CIA in the U.S. "war on terror" will ever emerge.

Polish officials deny that the CIA operated jails on Polish soil. They say they want a full and fair investigation, and that there is no political pressure on the prosecutors.

The prosecutors say they are doing their best to investigate the allegations, but that it is a slow process, not helped by the fact that U.S. authorities have not responded to requests for information.

However, lawyers for Abu Zubaydah and al-Nashiri say they suspect the investigation is being deliberately stalled because a trial would be politically embarrassing for the Polish state, and its allies in the United States.

According to documents filed by their lawyers, Abu Zubaydah, al-Nashiri and several other people believed by the CIA to be militants were flown in secret to a remote Polish airport.

They were then allegedly held, without a hearing before a judge or access to a lawyer, at a Polish intelligence academy at Stare Kiejkuty, a thickly forested area about 180 km (110 miles) north of the Polish capital. Their lawyers and rights activists say they were subjected to treatment that amounted to torture.

If Polish officials knew about the CIA operation, or provided support to it, that could be deemed a crime under Polish law and international human rights conventions.

U.S. officials have acknowledged that the CIA held al Qaeda suspects outside the United States, but have never publicly disclosed where or in what circumstances.

The U.S. government says Abu Zubaydah ran a camp in Afghanistan that trained some of those who carried out the September 11, 2001 attacks on U.S. cities. It accuses al-Nashiri of directing an attack on the U.S. warship Cole in the Yemeni port of Aden in 2000 that killed 17 sailors.

Cities affect temperatures for thousands of miles

Jan. 27, 2013 ? Even if you live more than 1,000 miles from the nearest large city, it could be affecting your weather.

In a new study that shows the extent to which human activities are influencing the atmosphere, scientists have concluded that the heat generated by everyday activities in metropolitan areas alters the character of the jet stream and other major atmospheric systems. This affects temperatures across thousands of miles, significantly warming some areas and cooling others, according to the study this week in Nature Climate Change.

The extra "waste heat" generated from buildings, cars, and other sources in major Northern Hemisphere urban areas causes winter warming across large areas of northern North America and northern Asia. Temperatures in some remote areas increase by as much as 1 degree Celsius (1.8 degrees Fahrenheit), according to the research by scientists at the Scripps Institution of Oceanography; University of California, San Diego; Florida State University; and the National Center for Atmospheric Research.

At the same time, the changes to atmospheric circulation caused by the waste heat cool areas of Europe by as much as 1 degree C (1.8 degrees F), with much of the temperature decrease occurring in the fall.

The net effect on global mean temperatures is nearly negligible -- an average increase worldwide of just 0.01 degrees C (about 0.02 degrees F). This is because the total human-produced waste heat is only about 0.3 percent of the heat transported across higher latitudes by atmospheric and oceanic circulations.

However, the noticeable impact on regional temperatures may explain why some regions are experiencing more winter warming than projected by climate computer models, the researchers conclude. They suggest that models be adjusted to take the influence of waste heat into account.

"The burning of fossil fuel not only emits greenhouse gases but also directly affects temperatures because of heat that escapes from sources like buildings and cars," says NCAR scientist Aixue Hu, a co-author of the study. "Although much of this waste heat is concentrated in large cities, it can change atmospheric patterns in a way that raises or lowers temperatures across considerable distances."

Distinct from urban heat island effect

The researchers stressed that the effect of waste heat is distinct from the so-called urban heat island effect. Such islands are mainly a function of the heat collected and re-radiated by pavement, buildings, and other urban features, whereas the new study examines the heat produced directly through transportation, heating and cooling units, and other activities.

The study, "Energy consumption and the unexplained winter warming over northern Asia and North America," appeared online January 27. It was funded by the National Science Foundation, NCAR's sponsor, as well as the Department of Energy and the National Oceanic and Atmospheric Administration.

Hu, along with lead author Guang Zhang of Scripps and Ming Cai of Florida State University, analyzed the energy consumption -- from heating buildings to powering vehicles -- that generates waste heat release. The world's total energy consumption in 2006 was equivalent to a constant-use rate of 16 terawatts (1 terawatt, or TW, equals 1 trillion watts). Of that, an average rate of 6.7 TW was consumed in 86 metropolitan areas in the Northern Hemisphere.

Using a computer model of the atmosphere, the authors found that the influence of this waste heat can widen the jet stream.

"What we found is that energy use from multiple urban areas collectively can warm the atmosphere remotely, thousands of miles away from the energy consumption regions," Zhang says. "This is accomplished through atmospheric circulation change."

The release of waste heat is different from energy that is naturally distributed in the atmosphere, the researchers noted. The largest source of heat, solar energy, warms Earth's surface and atmospheric circulations redistribute that energy from one region to another. Human energy consumption distributes energy that had lain dormant and sequestered for millions of years, mostly in the form of oil or coal.

Though the amount of human-generated energy is a small portion of that transported by nature, it is highly concentrated in urban areas. In the Northern Hemisphere, many of those urban areas lie directly under major atmospheric troughs and jet streams.

"The world's most populated and energy-intensive metropolitan areas are along the east and west coasts of the North American and Eurasian continents, underneath the most prominent atmospheric circulation troughs and ridges," Cai says. "The release of this concentrated waste energy causes the noticeable interruption to the normal atmospheric circulation systems above, leading to remote surface temperature changes far away from the regions where waste heat is generated."

TripIt Travel Organizer Free (for Android)


Booking a flight is as easy as clicking your mouse or tapping your screen, but doing so still generates an irritating amount of confirmation numbers, reservation numbers, and so on. TripIt Travel Organizer Free (free) aims to cut through the clutter with a dead-simple app for storing all your necessary travel information right on your phone. I previously reviewed the Tripit for iOS, and it was fine, but on Android it truly shines.

In order to get your travel information, users forward confirmation emails to a special TripIt email address. This works not only with flight information, but hotel, restaurant, rental car, and other reservations as well. You can also provide TripIt with your email account's username and password and the system with "automagically" hoover your upcoming trip information and push it to the app. Paranoid users may not want to grant a service that much access, but using an application-specific password with Gmail works just fine.

Users can also manually enter flight information into the app, or on the website, but the dead-simple importing process is great and, really, half the product.

Where The Magic Happens
Once it has your travel information, TripIt organizes the details of your trips and places them on your phone for offline access. At the very top of the homescreen, the app displays "what's next" in your travel plan as well as when and where that happens. Tapping this will pull up more information about the next step in your journey, such as flight departure time and gate information. TripIt also ties into Google Maps on Android, providing maps of the surrounding areas in addition to the app's own maps of airport terminals.

TripIt also sports some collaboration options, allowing you and other travelers to edit a single itinerary. You can also send their itinerary to other people (like the poor rube picking them up from the airport) with a tap, saving you the trouble of sorting out which information to send whom.

Appearance Is Everything
When I reviewed TripIt Travel Organizer for iOS and was disappointed that the app was so drab and uninspired. On the Samsung Galaxy SIII, the Android version takes full advantage of the phone's large, bright screen and delivers a clean interface that surpasses the iOS version's cramped design. Some of the controls assigned to the menu button and onscreen buttons are a little unintuitive, but that kind of unpredictability seems to be part and parcel of the Android experience.

On the Nexus 7?tablet, TripIt really comes into its own?especially when viewed in landscape mode. You don't lose your place as bright, spacious panels slide from right to left at a touch. When it displays navigation information, big Google-powered Maps fill the screen. It's a solid design, and my only complaint is that the app doesn't support left and right swiping instead forcing users to use the device's back-button.

TripIt offers four tiers of interaction for users. Users uninterested in spending any money can use TripIt's core functionality for free with an ad-supported version of the app. TripIt also offers an ad-free version for $3.99. There's also a corporate-level, where companies can use TripIt to manage travel information for an entire business. Business travelers can also take advantage of TripIt's close integration with SmartExpense, to quickly and easily produce and expense report.

The Pro Problem
TripIt also offers a Pro membership for $48.99 per year, which can be purchased from inside the app or through TripIt's website. With a Pro membership, users can receive flight status information in real-time; track frequent-flier points and other travel-related rewards systems; and alternate flight suggestions should you need them. Pro users can also have travel updates pushed to a list of individuals automatically, so the rube who picks you up from the airport will be informed that your flight is delayed while you're still in the air.

The Pro membership is clearly the thrust of TripIt's business, as both versions of the app retain all the Pro-only icons. Most of these are clearly marked, and clicking on them will pull up an ad to upgrade your account. However, there are many Pro-only options and constantly being prodded toward signing up for an expensive membership can be extremely irritating.

It's important to recognize that while TripIt brings a lot to the table, there's a lot of things it won't do. For instance, it doesn't store scannable boarding passes, though you can check-in for your flight if you are a Pro user. It also won't make travel arrangements for you. If you?re organizing a new trip manually, you'll need to have already made your plans. Even the alternate flights option for Pro users will only provide you with times, flight numbers, and a phone number to rebook yourself.

TripIt does, however, add some features through its partnership with other app developers.

At its core, TripIt is basically a digital wallet with some nice extras. The Pro membership is certainly not worth it unless you are a frequent traveler, given the price and the tools it provides. That's not to undercut the app or the service, because simply having that peace of mind and ease of access can certainly take the edge off traveling. If you need a dead-simple way to organize your travel plans, TripIt delivers.
